MiCA Intelligence Terms and Conditions

§1. General provisions
- These Terms and Conditions set out the rules for using the MiCA Intelligence website, available at https://micaintelligence.com, hereinafter referred to as the “Service”.
- The Service is an information platform whose purpose is to make it easier to choose a regulated European cryptocurrency exchange in an informed way, by providing an independent ranking, comparison tools and tools that support the decision-making process.
- Use of the Service is voluntary and free of charge.
- Use of the Service does not require creating a user account or logging in.
- By using the Service, the User confirms that they have read these Terms and Conditions and undertakes to comply with them.
- These Terms and Conditions have been drawn up in accordance with the applicable laws of the Republic of Poland.
§2. Definitions
For the purposes of these Terms and Conditions, the terms below have the following meanings:
Service - the MiCA Intelligence online platform available at micaintelligence.com.
Service Provider - LW Capital, the operator of the Service referred to in §14.
User - any person using the Service.
Ranking - a list of regulated European cryptocurrency exchanges prepared by MiCA Intelligence in accordance with the adopted assessment rules.
Comparison - a tool that makes it possible to compare the parameters of selected cryptocurrency exchanges.
Exchange Match - a tool that helps find an exchange based on the features and preferences indicated by the User.
Investor Archetype Test- a psychological tool that analyzes the User’s decision-making style and presents the result as an Investor Archetype and an Investment Awareness Age.
Investor Archetype - one of twelve profiles describing the dominant style of making investment decisions.
Investment Awareness Age - an indicator, independent of the Archetype, describing how developed the investment decision-making process is.
Regulated European cryptocurrency exchange - a crypto-asset service provider holding the required authorizations in accordance with the applicable law of the European Union.
§3. Types and scope of services
The following services provided by electronic means are available within the Service:
- A ranking of regulated European cryptocurrency exchanges.
- Profiles of individual exchanges containing information about their services, features and parameters.
- A tool for comparing selected exchanges.
- The Exchange Match tool, allowing an exchange to be chosen based on the preferences indicated by the User.
- The Investor Archetype Test, whose purpose is to help choose an exchange suited to the User’s decision-making style.
- A contact form enabling contact with the Service administrator.
- Educational and informational publications related to the crypto-asset market and regulated European cryptocurrency exchanges.
§4. Conditions for using the Service
- The agreement for the provision of services by electronic means is concluded the moment the User enters the Service.
- The agreement expires the moment the User leaves the Service.
- Using the Service requires:
- a device with Internet access,
- an up-to-date web browser,
- JavaScript enabled,
- cookie support to the extent necessary for the Service to function.
- The User undertakes to use the Service in accordance with applicable law, good practice and the provisions of these Terms and Conditions.
- It is prohibited to take actions that may disrupt the functioning of the Service, compromise its security or make it more difficult for other Users to use it.
- It is prohibited to send, through the contact form, content that is unlawful, offensive, infringes the rights of third parties or contains malicious software.
§5. Nature of the Service
- MiCA Intelligence is an information and educational platform.
- The purpose of the Service is to make it easier to choose a regulated European cryptocurrency exchange in an informed way, by presenting organized information, comparison tools and tools that support the decision-making process.
- The Service does not conduct brokerage activity, investment advisory, financial advisory, tax advisory or legal advisory.
- The information published in the Service does not constitute an offer within the meaning of the provisions of the Civil Code, nor an investment recommendation.
- Using the Service does not replace an independent risk assessment or the obligation to review the current terms of service of the chosen cryptocurrency exchange.
§6. Ranking of regulated European cryptocurrency exchanges
- The Ranking available in the Service is a list of regulated European cryptocurrency exchanges prepared by MiCA Intelligence in accordance with uniform assessment rules.
- All exchanges included in the Ranking are assessed according to the same criteria and the same assessment process.
- The order of exchanges in the Ranking results solely from the adopted assessment rules and does not depend on any commercial agreements, partner collaborations or the amount of remuneration received by the Service Provider.
- The possibility that the Service Provider may receive remuneration from partner programs or affiliate links does not affect the assessment or position of any exchange in the Ranking.
- The Ranking is informational in nature and serves to make it easier to choose a regulated European cryptocurrency exchange in an informed way. It does not constitute an investment recommendation, financial advice or an assurance that a given exchange will be the best choice for every User.
- The data used in the Ranking comes from information made available by exchange operators, their official materials, information provided by exchange representatives and other sources considered reliable by the Service Provider.
- The Service Provider exercises due care to keep the information published in the Ranking up to date; however, it may change. Before starting to use the services of a chosen exchange, the User should verify the current information directly on the exchange’s official website.
§7. Exchange Match
- The Exchange Match tool makes it possible to present the regulated European cryptocurrency exchanges that best match the preferences indicated by the User.
- The Exchange Match result is produced based on the answers and choices made by the User, as well as the parameters assigned to individual exchanges.
- The Exchange Match result is informational in nature and serves to support the exchange selection process.
- The result does not constitute an investment recommendation, financial advice or a guarantee that the indicated exchange will be the best solution for a specific User.
- The final decision on choosing an exchange and using its services rests solely with the User.
§8. Investor Archetype Test
- The Investor Archetype Test is a psychological tool developed to better understand the User’s investment decision-making style.
- After completing the Test, the User receives:
- an Investor Archetype,
- an Investment Awareness Age,
- a description of both results,
- three regulated European cryptocurrency exchanges that best match the result obtained.
- The Investor Archetype and the Investment Awareness Age are two independent results obtained within a single Test.
- The Investment Awareness Age does not follow from the Investor Archetype and is not part of it.
- The Test does not serve to assess a person, their competencies, knowledge, experience or professional aptitude.
- The Test result does not constitute a psychological diagnosis, an investment recommendation, financial advice or an assessment of the ability to make investment decisions.
- The purpose of the Test is to support the exchange selection process through a better understanding of one’s own decision-making style.
§9. Risk associated with investing in crypto-assets
- Investing in crypto-assets involves the risk of losing part or all of the invested funds.
- The results presented in the Service, positions in the Ranking, the results of the Exchange Match tool and the results of the Investor Archetype Test do not guarantee that any particular investment outcome will be achieved.
- The fact that a given exchange holds a license compliant with the MiCA regulation or other applicable law of the European Union means that certain regulatory requirements are met; however, it does not guarantee the safety of funds, the continuity of the exchange’s operations or that the User will make a profit.
- Every decision to buy, sell or hold crypto-assets is made by the User independently and at their sole risk.
§10. Partner programs and links to exchanges
- The Service may contain links leading to the websites of cryptocurrency exchange operators, including affiliate links.
- If the User uses an affiliate link, the Service Provider may receive remuneration from the exchange operator.
- Neither partner collaboration nor the possibility of receiving remuneration affects the assessment of exchanges, their position in the Ranking or the results of the tools made available in the Service.
- After moving to an exchange operator’s website, the User uses it under the terms and conditions, privacy policy and other documents applicable at that operator.
- The Service Provider is not responsible for the content, services, operation or decisions of the exchange operators to which links posted in the Service lead.
§11. Copyright
- All content published in the Service, in particular texts, descriptions, graphics, data compilations, graphic designs, interface elements, educational materials, the names of the Investor Archetypes, result descriptions, the way data is presented and the other materials made available by MiCA Intelligence, is protected under copyright law and other provisions on the protection of intellectual property.
- Unless expressly stated otherwise, the rights to the materials published in the Service belong to MiCA Intelligence or to entities that have granted the relevant licenses to use them.
- Use of the Service’s content for one’s own use is permitted to the extent resulting from applicable law.
- Without the prior written consent of MiCA Intelligence, it is prohibited in particular to:
- copy all or significant parts of the Ranking,
- mass-download data from the Service using automated tools,
- create copies of the Service’s database,
- use the Service’s content to build competing rankings or comparison tools,
- publish the Service’s content as one’s own materials.
- The above restrictions do not exclude the User’s rights arising from applicable law, in particular those concerning permitted use.
§12. Contact form and complaints
Contact form
- The Service provides a contact form enabling questions to be asked and comments to be submitted regarding the operation of the Service.
- When using the contact form, the User undertakes to provide true information and not to send content that is unlawful, offensive or infringes the rights of third parties.
- Messages sent through the form are used solely to provide a response and to conduct correspondence related to the request.
Complaints
- Complaints regarding the operation of the Service may be submitted electronically to: contact form
- A complaint should include as accurate a description of the problem as possible, along with the information needed to provide a response.
- MiCA Intelligence handles complaints without undue delay, no later than within 14 days of receiving them.
- If providing a response within the above period proves impossible for reasons beyond MiCA Intelligence’s control, the User will be informed of the reason for the delay and of the expected date on which a response will be provided.
§13. Protection of personal data
- The rules for processing personal data are described in a separate Privacy policy.
- The rules for using cookies are described in a separate Cookie policy.
- Using the Service may involve the processing of personal data solely to the extent necessary to provide the services and in accordance with applicable law.
§14. Information about MiCA Intelligence
The operator of the Service and the entity providing services by electronic means is:

- MiCA Intelligence is an independent information platform.
- MiCA Intelligence is not a public administration authority, an institution of the European Union or an entity acting on behalf of such institutions.
- The name “MiCA Intelligence” refers solely to the activity conducted by the operator of the Service and does not imply any organizational affiliation with European Union institutions or supervisory authorities.
§15. Changes to the Terms and Conditions
- MiCA Intelligence may change these Terms and Conditions in the event of:
- changes in the law,
- an expansion or change of the Service’s functionality,
- a change in the way services are provided,
- a need to clarify the provisions of these Terms and Conditions.
- The current version of the Terms and Conditions is always published in the Service.
- Each version of the Terms and Conditions includes a version number and an effective date.
- Using the Service after a new version of the Terms and Conditions takes effect means acceptance of its current content.
§16. Final provisions
- The law of the Republic of Poland applies to the use of the Service.
- The choice of Polish law does not deprive a consumer of the protection given by the mandatory provisions of the law of their country of residence.
- In matters not regulated by these Terms and Conditions, the applicable provisions of Polish law and the relevant provisions of European Union law apply.
- If any provision of these Terms and Conditions proves to be invalid or ineffective, this does not affect the validity of the remaining provisions.
- A consumer may use the out-of-court methods of resolving disputes provided for by applicable law.
- These Terms and Conditions take effect on the date indicated in their header.
- These Terms and Conditions were drawn up in Polish. In the event of any discrepancy between the Polish version and a translation into another language, the Polish version shall prevail.
